Resolving technical failures fairly

Refund policy

MerchKern distinguishes technical non-performance, statutory remedies and purely subjective dissatisfaction.

Last updated: 16 August 2026

Legal draft. Technical reversal is prepared; final professional legal and tax review remains required before publication.

On this page
  1. 1. Statutory rights remain available
  2. 2. Technical failure
  3. 3. No additional right for subjective dissatisfaction
  4. 4. Subscriptions and credit packs
  5. 5. Separately confirmed rework
  6. 6. Report a problem

1. Statutory rights remain available

Your statutory rights, including any applicable right of withdrawal and remedies for digital products that are not supplied or are defective, remain unaffected. This policy also describes our voluntary handling of technical problems.

2. Technical failure

If an output is not technically delivered during the initial generation run, the reserved credits for that output are generally restored automatically. For a delivered file that is technically non-conforming, we first assess resupply, reprocessing or restoration of the affected credit.

If remediation fails or statutory conditions are met, you may be entitled to a price reduction, termination and reimbursement. A monetary refund required by law is generally made through the original payment method and is not replaced solely with credits against your will.

3. No additional right for subjective dissatisfaction

A purely subjective difference from your personal taste does not create an additional voluntary refund right where the output meets the agreed and advertised characteristics.

  • A different creative effect from the one personally hoped for
  • Input errors, ambiguous instructions, or missing rights in references
  • Marketplace rejection where there is neither a material or legal defect attributable to MerchKern nor a separately warranted characteristic
  • Differences caused by print providers, materials, colour profiles or print areas outside the MerchKern file contract

4. Subscriptions and credit packs

Ordinary cancellation applies to future billing periods. There is no additional voluntary pro-rata refund for a current paid period merely because it was not used; statutory withdrawal, defect and reimbursement rights remain available.

You select a plan or pack on MerchKern and continue directly to Stripe Checkout without an intermediate confirmation screen. The Terms, refund policy and withdrawal information are linked on the subscription page before you continue to Stripe. No separate declaration for early performance is currently collected. This simple Checkout design does not change mandatory withdrawal rights. Consuming one credit does not automatically extinguish the withdrawal right for an entire subscription and does not by itself determine a deduction. Whether compensation is owed after a valid withdrawal depends exclusively on the statutory requirements and the specific classification of the service. Technically failed outputs and restored reservations remain unconsumed in any event.

Free, bonus and goodwill credits have no cash value. A successfully delivered output does not create an additional voluntary refund right for the credits consumed for it. Mandatory statutory rights remain unaffected.

5. Separately confirmed rework

For separately confirmed paid rework, the displayed credits are reserved first and consumed only after the revised result has been stored and delivered. If technical processing fails before delivery, the reserved credits are restored. Purely subjective dissatisfaction after successful delivery does not create an additional voluntary refund right; statutory rights remain unaffected.

6. Report a problem

Send your account email, run or payment reference, a short description and, where useful, a screenshot. Never send full card details or credentials.
